Liftline — Terms of Service

About these summaries: Each section begins with a short plain-English summary for convenience. The summaries are not part of these Terms and do not change the legal provisions that follow. If a summary and the full text differ, the full text controls.
1. Agreement to Terms
Basically: By using Liftline, you agree to these Terms. We may update them and will provide reasonable notice when a change materially affects your rights or obligations.
By accessing or using Liftline ("the Service"), operated by Caradhras Technologies, Inc. ("Liftline," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
Liftline may update these Terms from time to time. If a change materially affects your rights or obligations, we will provide reasonable notice through the Service or by other reasonable means. Updated Terms will identify their effective date. Where applicable law requires your consent to a change, we will ask for it. Otherwise, your continued use of the Service after the updated Terms take effect constitutes acceptance of the updated Terms.
2. Eligibility
Basically: Liftline's interactive features are for adults 18 and older. We rely on the birthdate you provide and may restrict access if we learn that someone is ineligible.
You must be at least 18 years old to create an account, submit a guest RSVP, or otherwise use an interactive feature of Liftline. By doing so, you represent and warrant that you are at least 18 years of age. Liftline uses self-reported birthdate information for its account age gate but does not independently verify every user's age or identity. If we learn that an ineligible person has used an interactive feature of the Service, we may suspend or terminate access and handle the person's information as described in the Privacy Policy.
3. Description of Service
Basically: Liftline gives users and clubs tools to connect, communicate, share information, and coordinate activities. Users and clubs—not Liftline—organize real-world activities, and third-party services apply their own terms.
Liftline is a platform that enables skiers and snowboarders to discover and connect with other skiers and snowboarders. Liftline provides tools for users to create profiles; browse and communicate with other users; publish posts, replies, photos, conditions information, check-ins, and reactions; plan and share trips; indicate ride availability or needs; join clubs and club channels; create or RSVP to events; and share certain posts, events, and trips through web links.
Club administrators may manage club membership, roles, invitations, channels, announcements, events, and RSVP information through the Service. Certain club tools can help administrators extract event information or prepare drafts for administrator review. Liftline does not organize, supervise, or participate in any in-person meeting, ski outing, club activity, event, trip, carpool, or other activity between users.
The Service may include links to third-party sites or services, including event-registration pages and social profiles. Those third parties are independent of Liftline, and their terms and privacy practices apply when you use them.
3A. Liftline Intellectual Property and Service License
Basically: Liftline and its licensors own the Service and brand. You receive limited permission to use Liftline as intended, but you may not copy, resell, reverse engineer, scrape, bypass controls, or interfere with it.
The Service—including its software, interfaces, visual designs, graphics, features, databases and compilations, technology, documentation, and Liftline names, logos, and trademarks—is owned by Liftline or its licensors and is protected by intellectual-property and other laws. These Terms do not transfer ownership of the Service or any Liftline intellectual property to you. User Content is addressed separately in Section 8.
Subject to your compliance with these Terms, Liftline grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service through the interfaces Liftline provides for its intended purposes, including authorized club administration.
Except where applicable law does not permit a restriction, you may not:
- Copy, reproduce, modify, translate, create derivative works from, distribute, publicly display, or publicly perform any part of the Service except as expressly allowed by Liftline or these Terms.
- Rent, lease, sell, resell, sublicense, assign, or commercially exploit access to the Service.
- Reverse engineer, decompile, disassemble, or attempt to derive source code, underlying ideas, algorithms, or nonpublic APIs from the Service.
- Scrape, crawl, harvest, index, or use automated means to access the Service or collect Service data without Liftline's prior written permission, except for ordinary public-web indexing that Liftline has not technically prohibited.
- Bypass or defeat authentication, rate limits, visibility settings, access controls, security measures, or restrictions on public, club, trip, event, or invitation links.
- Introduce malware, interfere with the Service, access another person's account, or use the Service or Service data in a way that violates law, another person's rights, or these Terms.
- Remove or obscure proprietary notices or misrepresent that Liftline sponsors, endorses, or is affiliated with you or your activities.
4. Assumption of Risk
Basically: Snow sports, mountain travel, and meeting or riding with other people can cause serious injury or death. You—not Liftline—are responsible for evaluating the people, information, terrain, weather, equipment, transportation, and other risks involved.
Skiing, snowboarding, travel in mountain environments, and related snow sports are inherently dangerous activities that carry a risk of serious injury or death. By using Liftline, you acknowledge and agree that:
- You participate in all skiing, snowboarding, travel, events, meetups, carpools, and related activities entirely at your own risk.
- Liftline does not vet, screen, verify, conduct background checks on, or continuously monitor its users. You are solely responsible for evaluating the suitability and trustworthiness of any user, club, driver, passenger, host, or attendee you choose to interact with or meet.
- Any decision to meet another user in person, ski or ride together, attend an event, join a trip, share a ride, or engage in any activity—including backcountry skiing, sidecountry skiing, or any activity outside resort boundaries—is made entirely at your own discretion and risk.
- You are solely responsible for assessing terrain, weather, road and avalanche conditions, your own ability level, equipment, transportation, and any other factor relevant to your safety.
- Posts, conditions reports, weather information, trip details, meeting locations, and other information available through the Service may be incomplete, delayed, inaccurate, or supplied by other users. Liftline is not an emergency service, safety service, guide, transportation service, or substitute for official information, proper safety equipment, avalanche education, or professional instruction.
You voluntarily assume all risks associated with using the Service and with any online or in-person interaction or activity that results from or is coordinated through the Service, including the risk of bodily injury, property damage, or death.
4A. Carpools and Ride Coordination
Basically: Liftline only helps users discuss rides; it does not provide, supervise, verify, or insure them. Drivers and passengers arrange rides themselves and are responsible for assessing one another, the vehicle, insurance, payment, and safety.
Liftline may let users indicate that they can offer a ride, need a ride, or want to discuss transportation. Any ride is arranged directly between users. Liftline is not a transportation carrier, broker, dispatcher, employer, or agent of a driver or passenger and does not provide, control, supervise, or insure a ride.
Liftline does not verify a driver's identity, license, driving history, insurance, sobriety, vehicle ownership, vehicle condition, tires, equipment, route, or ability to drive in particular conditions, and it does not verify a passenger's identity or conduct. Drivers and passengers are independently responsible for deciding whether to ride together, complying with applicable law, evaluating one another and the vehicle, making appropriate insurance and payment arrangements, and taking precautions suitable to the circumstances.
5. Limitation of Liability
Basically: To the extent the law allows, these Terms limit the types and amount of damages you can recover for harms connected to Liftline, its content, its users, and user-arranged activities. Liftline's total liability is capped at what you paid Liftline during the preceding 12 months.
To the fullest extent permitted by applicable law, Liftline and its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use the Service.
- Any interactions, communications, meetings, events, trips, carpools, or other arrangements with users, clubs, drivers, passengers, hosts, administrators, or third parties, whether online or in person.
- Any injury, illness, death, property damage, transportation loss, or other harm arising from activities undertaken in connection with or as a result of using the Service.
- Any conduct or content of any user, club, administrator, guest, or third party, whether online or offline.
- Any reliance on user content, conditions information, weather information, meeting details, directions, or other information made available through the Service.
- Unauthorized access to or alteration of your data or communications.
In no event shall Liftline's total aggregate liability exceed the amount you have paid to Liftline, if any, in the twelve (12) months preceding the claim.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the limitations above may not apply to you.
6. Indemnification
Basically: If a claim against Liftline arises from your use of the Service, your content, your club or event administration, your violation of these Terms, or your dealings with others, you agree to cover the resulting losses and defense costs.
You agree to indemnify, defend, and hold harmless Liftline and its owners, operators, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your User Content, your administration of a club or event, your violation of these Terms, or your online or in-person interactions and arrangements with other users or third parties.
7. User Conduct
Basically: Use Liftline honestly and safely. Do not break the law, harm or exploit people, invade privacy, spam, automate abuse, or bypass controls. Serious conduct connected to Liftline can lead to content or account restrictions even when it happens off-platform.
You agree not to:
- Impersonate any person or misrepresent your identity, age, affiliation, authority, or intentions.
- Use the Service for any unlawful, fraudulent, deceptive, or exploitative purpose.
- Harass, threaten, stalk, intimidate, discriminate against, exploit, or abuse any other person.
- Transmit content that is harmful, threatening, defamatory, obscene, sexually exploitative, infringing, invasive of privacy, or otherwise objectionable.
- Post another person's private information or image without having the rights and permissions needed to do so.
- Use the Service to solicit money or other items of value through fraud, coercion, or deception.
- Use the Service for unauthorized commercial solicitation or spam. Ordinary club administration and activities permitted by Service features are not prohibited by this clause.
- Use bots, scripts, or automated systems to create accounts, send messages, manipulate engagement, or otherwise misuse the Service.
- Attempt to gain unauthorized access to the Service, another user's account, or related systems, or to bypass visibility, invitation, blocking, or security controls.
- Help or encourage another person to do any of the above.
These conduct rules apply both to activity on the Service and to serious off-platform conduct arising from or connected to an interaction coordinated through Liftline. This includes conduct during skiing or snowboarding, club activities, events, trips, meetups, carpools, or communications moved to another service. Liftline may consider credible reports of off-platform violence, threats, harassment, stalking, sexual misconduct, fraud, dangerous conduct, or other serious behavior that creates a safety, legal, or community risk.
Liftline may, but is not required to, review reports or content and may remove or restrict content, limit features, revoke a club role, suspend, or terminate access, with or without notice, if Liftline reasonably believes action is appropriate to enforce these Terms, protect users or the Service, address fraud or abuse, comply with law, or reduce a safety or legal risk. Liftline does not promise to monitor all activity, investigate every report, verify all off-platform allegations, achieve a particular outcome, or supervise any real-world interaction.
8. User Content
Basically: You keep ownership of what you submit, but you give Liftline permission to use it as described below to operate and support the Service. You must have the right to share your content, and deletion cannot retrieve copies held by others or eliminate every permitted retained record.
"User Content" includes photos, text, profiles, posts, replies, reactions, check-ins, conditions reports, messages, club-channel content, event and trip information, ride notes, reports, and other material you submit, upload, send, or make available through Liftline. You retain ownership of your User Content.
By providing User Content, you grant Liftline a non-exclusive, worldwide, royalty-free license to host, store, cache, reproduce, format, adapt for technical requirements, publish, display, perform, distribute, and otherwise use that content as reasonably necessary to operate, provide, secure, moderate, improve, and promote the Service in a manner consistent with the feature and visibility setting you selected. This license includes the right to:
- Display content to the users, club members, event attendees, trip participants, administrators, or link holders authorized by the applicable feature or visibility setting.
- Display content on publicly accessible or bearer-link web pages and provide associated metadata—such as a display name, username, text, date, place, image, event or trip detail, and participation count—to platforms that generate link previews.
- Use service providers to process User Content on Liftline's behalf, including storage, delivery, safety review, analytics, and task-specific artificial-intelligence processing described in the Privacy Policy.
- Make technical modifications needed to resize, transcode, format, transmit, or display content across devices and surfaces.
The license ends when your User Content is deleted from Liftline's active systems, except to the extent continued retention or use is reasonably necessary for backups, security, fraud prevention, moderation evidence, legal compliance, dispute resolution, enforcing these Terms, or content that other users have independently copied, shared, cached, or incorporated into their own content as permitted by the Service.
You understand that other users may share content through public or bearer links and that, once content is disclosed, it may be viewed, screenshotted, cached, archived, or redistributed outside Liftline's control. Deleting or disabling content removes the Liftline page or in-Service copy where the feature supports deletion, but it cannot retract copies held by others or third-party caches.
You are solely responsible for your User Content and represent that you have all rights and permissions necessary to provide it and grant the license above, including permissions relating to other people depicted or identified in your content. You may not provide User Content that infringes intellectual-property, privacy, publicity, or other rights or violates law or these Terms.
8A. Clubs, Events, Trips, and Shared Links
Basically: Club administrators, organizers, and hosts—not Liftline—manage their groups and activities and must use member and guest information lawfully. Shared links and invitation codes can be forwarded, so audience settings do not guarantee confidentiality.
Club administrators may control membership and roles; rotate invitation codes; manage club settings and channels; create, edit, cancel, or delete events; remove certain club-channel content; send announcements; and view member and RSVP information made available to administrators. Other club members may see roster information such as names, usernames, profile images, and administrator status. Club affiliations and administrator roles may also appear on profiles.
If you administer a club, you represent that you are authorized to act for that club and to provide the information and content you submit. You are responsible for using member and guest information only for authorized, lawful club purposes and in accordance with the consent presented to the person. In particular, a club administrator who receives a guest's name and phone number through an event RSVP may use that information only to communicate about that event as described at collection. A club and its administrators act independently and are not Liftline's employees, agents, or representatives.
Event organizers and trip hosts control event or trip details and certain participation decisions. Liftline does not endorse a club, event, host, attendee, trip, or third-party registration provider and is not responsible for membership decisions, cancellations, communications, fees collected outside Liftline, or disputes among participants.
Public links, club invitation codes, and trip share or invitation links may be forwarded. Anyone who receives a working link or code may be able to view the associated preview information, request or obtain access, join a trip or club where the feature permits, or share the link again. "Members-only," "close friends," or "invite-only" settings limit Liftline's intended audience but do not guarantee confidentiality or prevent an authorized recipient from copying content or forwarding a bearer link. You are responsible for choosing an audience and sharing links and codes carefully.
8B. Copyright Complaints
Basically: Only post content you have the right to share. Liftline may remove content it reasonably believes is infringing, and copyright complaints can be emailed to support.
Liftline respects intellectual-property rights. You may not upload or share User Content that infringes another person's copyright or other rights. Liftline may remove or disable access to content, or restrict an account, if Liftline reasonably believes the content infringes another person's rights or violates these Terms.
If you believe content on the Service infringes your copyright, contact support@theliftline.app and identify the copyrighted work, the content you believe infringes it, where that content appears on Liftline, your contact information, and the basis for your complaint.
9. Privacy
Basically: Our Privacy Policy explains how Liftline handles information. If you permit location access, Liftline stores precise foreground location for nearby discovery and related features; Ghost Mode changes certain profile visibility but does not stop collection, delete stored location, or hide all activity.
Your use of Liftline is also governed by our Privacy Policy. By using the Service, you acknowledge the collection, use, disclosure, and retention practices described there.
With your device permission, Liftline collects and stores foreground precise location to provide nearby discovery and related features. Standard product interfaces use this information to calculate approximate distance and do not display raw coordinates. Ghost Mode can hide selected profile indicators, but it does not stop collection, erase stored location, or hide all posts, plans, check-ins, event activity, club activity, or direct interactions. You may revoke device location permission at any time, but doing so may limit functionality and does not by itself delete information already stored.
10. No Warranty
Basically: Liftline is provided as available, without promises that it will always work or be secure, or that its users, information, activities, or third-party services will be accurate, trustworthy, suitable, or safe.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Liftline does not warrant that the Service will be uninterrupted, error-free, secure, or accurate, that defects will be corrected, or that any user, club, administrator, event, trip, driver, passenger, User Content, conditions report, weather information, or third-party service is trustworthy, suitable, accurate, or safe.
11. Dispute Resolution
Basically: Disputes begin with 30 days of good-faith informal negotiation. Unresolved disputes must be decided through individual binding arbitration in California, not through a class, collective, or representative proceeding.
You agree that any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association. Any arbitration shall take place in the State of California.
You agree that any claims shall be brought in your individual capacity and not as a plaintiff or class member in any purported class action, collective action, or representative proceeding.
12. Governing Law
Basically: California law governs these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
13. Severability
Basically: If one provision cannot be enforced, the rest of the Terms remain in effect.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
