Liftline — Terms of Service

1. Agreement to Terms

By accessing or using Liftline ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Liftline reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old to use Liftline. By creating an account, you represent and warrant that you are at least 18 years of age.

3. Description of Service

Liftline is a platform that enables skiers and snowboarders to discover and connect with other skiers and snowboarders. Liftline provides tools for users to create profiles, browse other users, and communicate with one another. Liftline does not organize, supervise, or participate in any in-person meetings, ski outings, or activities between users.

4. Assumption of Risk

Skiing, snowboarding, and related snow sports are inherently dangerous activities that carry a risk of serious injury or death. By using Liftline, you acknowledge and agree that:

  • You participate in all skiing, snowboarding, and related activities entirely at your own risk.
  • Liftline does not vet, screen, verify, or conduct background checks on its users. You are solely responsible for evaluating the suitability and trustworthiness of any user you choose to interact with or meet in person.
  • Any decision to meet another user in person, ski or ride together, or engage in any activity — including but not limited to backcountry skiing, sidecountry skiing, or any activity outside of resort boundaries — is made entirely at your own discretion and risk.
  • You are solely responsible for assessing terrain, weather conditions, avalanche risk, your own ability level, and any other factors relevant to your safety.
  • Liftline is not a substitute for proper safety equipment, avalanche education, or professional instruction.

You voluntarily assume all risks associated with using the Service and with any in-person interactions or activities that result from connections made through the Service, including the risk of bodily injury, property damage, or death.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Liftline and its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Service.
  • Any interactions, communications, or meetings with other users of the Service, whether online or in person.
  • Any injury, illness, death, or property damage arising from activities undertaken in connection with or as a result of using the Service.
  • Any conduct of any user of the Service, whether online or offline.
  • Unauthorized access to or alteration of your data or communications.

In no event shall Liftline's total aggregate liability exceed the amount you have paid to Liftline, if any, in the twelve (12) months preceding the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Liftline and its owners, operators, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your interactions with other users.

7. User Conduct

You agree not to:

  • Impersonate any person or misrepresent your identity, age, or affiliation.
  • Use the Service for any unlawful purpose.
  • Harass, threaten, stalk, or intimidate any other user.
  • Transmit any content that is harmful, offensive, obscene, or otherwise objectionable.
  • Use the Service to solicit money or other items of value from other users.
  • Use the Service for any commercial purpose without prior written consent from Liftline.
  • Attempt to gain unauthorized access to the Service or its related systems.

Liftline reserves the right to suspend or terminate your account at any time, for any reason, without notice.

8. User Content

You retain ownership of the content you post on Liftline, including photos, text, and other materials. By posting content on the Service, you grant Liftline a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating and promoting the Service.

You are solely responsible for the content you post and represent that you have all necessary rights to post such content.

9. Privacy

Your use of Liftline is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

Liftline collects and uses location data to provide core functionality of the Service. You may revoke location permissions at any time through your device settings, but doing so may limit the functionality of the Service.

10. No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Liftline does not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

11. Dispute Resolution

You agree that any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association. Any arbitration shall take place in the State of California.

You agree that any claims shall be brought in your individual capacity and not as a plaintiff or class member in any purported class action, collective action, or representative proceeding.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
